Federal judges overturn Ohio man's death sentence A federal appeals court has overturned the conviction and death penalty of an Ohio man accused of beating his roommate and burying him alive, finding police coerced his confession. A panel of the 6th U.S. Circuit Court of Appeals in Cincinnati made the ruling Thursday in the case of Toledo resident Archie Dixon. He was convicted in Lucas County in the 1993 slaying of Christopher Hammer. The ruling overturned a 2004 Ohio Supreme Court decision that had upheld the use of Dixon's confession in his trial despite a police decision not to initially read Dixon his rights. The appeals court ruling says police planned to get a murder confession by not advising Dixon of his rights initially. The court has given prosecutors six months to retry Dixon. Court reverses decision throwing out death sentence for man convicted of burying victim alive The Supreme Court says a lower court was wrong when it threw out the death penalty and conviction of a man accused of beating his roommate and burying him alive. The court on Monday issued an unsigned opinion that reverses the dismissal of Archie Dixon’s death sentence. The 6th U.S. Circuit Court of Appeals had said Dixon’s confession was coerced by police. Dixon was to be executed by the state of Ohio for the 1993 slaying of Christopher Hammer. Hammer was beaten and robbed on Sept. 22, 1993, and then was driven to a remote area, where he was buried alive in a shallow grave. The Ohio Supreme Court had upheld his death sentence, a decision the Supreme Court said must be respected. The case is Bobby v. OHIO SUPREME COURT SETS FIVE EXECUTION DATES The Ohio Supreme Court has set five execution dates, including one for a Stark County man convicted in a 1984 murder in Canton. Justices’ action Monday means David Sneed, James Derrick O’Neal, Elwood Hubert Jones, Archie Dixon and Timothy Hoffner join 16 other Death Row inmates awaiting their capital punishment. Sneed was sentenced to death for the murder of Herbert Rowan. According to documents, Sneed and an accomplice approached Rowan seeking a ride, then demanded money and shot Rowan in the head. The state’s high court set Sneed’s execution for Aug. 1, 2018, the first scheduled in that year. O’Neal, convicted in the 1993 murder of his estranged wife in Cincinnati, faces an Oct. 10, 2018, execution date. Jones, convicted in the 1994 killing of a Cincinnati-area hotel employee, faces a Jan. 9, 2019, execution date. Dixon and Hoffner beat and buried alive a 22-year-old Toledo man in 1993.
