Bill Mason, Cuyahoga County Prosecutor: No more money wasted re-trying Michael Keenan Michael Keenan will face a judge for the third time on September 24 for the murder of Tony Klann, despite a wealth of information that suggests this trial is a shameful waste of tax payer’s dollars and an intolerable miscarriage of justice. Mr. Keenan’s original conviction was dismissed because of prosecutorial misconduct, specifically that the prosecutor's office withheld evidence that would have likely exonerated him at the time of trial. Mr. Keenan was then awarded another trial in 1994, was convicted again, and sentenced to death. Now that conviction has been dismissed because of prosecutorial misconduct—again—and now he will stand trial for the same crime—again. In January of 2012, Mr. Keenan’s co-defendant Joe D’Ambrosio was exonerated from death row. Two men were convicted of the same terrible crime, but when new evidence surfaced, one man was exonerated while the other remains in jail. Now Michael Keenan awaits his day for justice. The Cleveland Plain Dealer noted, “U.S. District Judge David Katz has ruled that Keenan must either be tried again or have his conviction set aside. Katz cited evidence that county prosecutors withheld facts that might have exonerated Keenan.” Mr. Keenan’s retrial has less to do with justice and more to do with someone, anyone paying the price for the murder of Tony Klann-- even if it is an innocent man. Re-trying Michael Keenan is a blatant waste of tax payer’s money and an insult to justice in Cuyahoga County. The Cleveland Plain Dealer editorial board said, “Prosecutor Bill Mason ought not to waste his staff's time and the public's money defending indefensible actions his office took almost a quarter-century ago. Nor should he risk another black eye for his office today pursuing a case that is rife with reasonable doubt.” If the Prosecutor’s office had acted appropriately from the beginning, our resources could have been spent bringing the real perpetrator to justice.
