Ohio Supreme Court weighs woman's death sentence The Ohio Supreme Court is once again weighing whether to uphold the sentence of the only woman on death row in the state. Attorneys for Donna Roberts plan to tell justices Tuesday that evidence showing their client was mentally ill and suffered brain trauma should have been considered by the judge who resentenced her to death in 2007. Mental illness led woman to murder, justices told in review of death sentence Ohio’s lone woman on Death Row has asked the high court to spare her life for killing her ex-husband in a plot with her boyfriend. Attorneys for Donna Marie Roberts told the Ohio Supreme Court yesterday that a trial judge failed to consider her mental illness, low intelligence and other mitigating factors before resentencing her in 2007 to the death penalty. “There are real mental-health problems here ... bipolar disorder, depression ... her IQ is 55,” Roberts’ attorney, David L. Trumbull County woman's death sentence canceled for a second time The Ohio Supreme Court has once again nullified the death sentence of a former Trumbull County woman convicted of plotting her former husband's murder. Donna Roberts is the only woman on Ohio's death row. The Howland woman was convicted of conspiring with her lover in 2001 to murder her former husband Robert Fingherhut. Tuesday, the Ohio Supreme Court agreed with her attorney who said that the judge who re-sentenced Roberts ignored evidence showing their client was mentally ill and suffered brain trauma. In 2001, police-monitored phone calls and letter exchanges between Roberts and her lover, prison inmate Nathaniel Jackson, showed they planned to murder Fingerhut. Two days after Jackson's release in December 2001, Fingerhut was shot to death at home. Jackson was convicted of murdering Fingerhut and was sentenced to death. Ohio Supreme Court to hear appeal in Howland murder case The Ohio Supreme Court will hear the appeal of a woman sentenced to death for her part in the 2001 murder of her husband in Trumbull County. A February 7 hearing has been scheduled for Donna Roberts, who along with her lover Nathaniel Jackson, were convicted of killing Robert Fingerhut in Howland Township.
