Ok now that I have made it off from the introduction page Im wondering how they can put a man away and sentence him too death with such shakey evidence and the so called evidence they do have is very little on Brett Im truely baffled that they can kill a man without hearing the new and the old evidence,putting them together and get the truth out, a mans life is at stake here and I beleive anyone who just reads a little into this case will see it deserves a new trial,its just getting the right person or persons to listen.Please keep me informed and Im going to send a few folks this way so they too will put this on their web page.Your brother is touching lives of people he does not even know.

If you look at the studies about the causes of wrongful convictions, you will see that Brett's case contains most of these aspects. Prosecutorial misconduct, hidden exculpatory evidence, rush to convict, jail house snitch testimony, death qualified juries, bad lawyering, etc, just to name a few.
I had one person contact me about testimony that was given at Brett's trial. This person knew it to be false, but is afraid to come forward for a number of reasons.
In the end the comment I received was that; perhaps what they knew was not of importance since a "jury" had convicted Brett. Brett's "jury" did not have all the facts, there is a great deal that was hidden from them. Not only hidden by the prosecutor, but also by his own attorneys.
Brett's original trial attorney, Whittney, is well known there on death row. "He's sent another one to death row" is a common phrase. One of his most recent clients tried to get a different attorney but was denied.
It is a long uphill battle...a battle that you are forced to fight with your hands tied behind your back. Thank you to everyone who is willing to help us in that fight!

No personal relationship to speak of. I believe it was of the type, couple of beers, and casual sex. He was only given a cursory glance even though everyone who knew her believed he was the one capable of this crime, and had access to her apartment buildings master keys. One of her friends, and several neighbors testified to this at Brett's trial. Boyfriends alibi was that at the time of the crime he was at home drinking beer with his buddies. As far as we know this was the extent of the investigation...just his word.

Thank you for these postings and links cincykid, especially the one to the Governor. I had included it on Brett's website, but had not thought to place one here. Sometimes fresh eyes are exactly what is needed. ;D It is my sincere hope that the stay for Henderson will be upheld. I know this may sound strange for some people to hear if they are not familiar with the death penalty, and the issues related to it there in Ohio...but we will all be glad to see him returned to Youngstown. (Jeffrey Lundgren had also been included in the suit based on lethal injection being cruel and unusual punishment. In the end his stay of execution was lifted and he was executed anyway). As this new year gets under way, hopefully the new Governor and new attorney general will have a more positive influence over these men!

You know I have never really even given a thought to the death penalty until just recently and the more I think about it the more Im totally against haven our goverment to be able and murder its own people is very barberic and really a stone age way of sending a message that is much better felt if the peron/persons are incarcerated for life and no less than true life that would be the most severe punishment that the goverment is aloud to give,they are not God,we are not God,we cant say that we are cristians only when it fits our needs,but to love is to know God,Im against the death penalty mainly because innocent people die and you cant take back death,among a various of other reasons.Brett is an Icon for all innocent men on the row and for what its worth a Hell of a man too handle this with such head on determination,if Brett is executed it will pull a Dark cover over Ohio and the people in it , for that will be the day we have an innocent mans blood on our hands....Tell him my thoughts and prayers are with him,if he dont beleive in religieon then tell him too humor me for the big GUY does exist.When a peice of the puzzle does not fit,we do not cut the edges to make it fit.(unity)Gene

Thank you for your thoughts, and message cincykid. I too was very uninformed about the death penalty till all of this happened, what a learning experience . I will print out this posting and send it to Brett. I've only just recently told Brett about this forum. He had made the comment that over the holiday (Thanksgiving)he hadn't gotten much mail so I sent him a huge pack of mail. Pages from this forum, the pages I had added to his website, and pages from Diane's Days, just to tide him over.

Hello folks sorry I have not been here in awhile but my health has been a real trial in itself for the past five years so many things have happened besides my health that I just find myself overwhelmed with it all happening at once I will follow Bretts case to the end though because Im not here to say weather he is guilty or not guilty what I am here to say is he has not been given a fair chance to even prove his case,from the evidence Ive read and as I said everyone here knows what we know,my non bias opinion is Brett is innocent.And I feel bad for a man setten on death row for a crime he didnt commit when I spend time with my family and he cannot,because it is everyday normal folks like myself who has closed their eyes to what is right and wrong and Brett got caught in the middle of politicians not wanting to admit our system screws up,oh but it does and someday it may just be that prosecutor who finds himself to be(IN THE WRONG PLACE AT THE WRONG TIME)Gene

You know when I look at this case I feel we take alot of things in our lives for granted,I mean this could very well be me or a loved one in my family,and its sad to know that I could just happen to be somewhere and something like this could very well be pinned on me,I mean what would you do?what could you do?I mean if its a friend your first thing would to see if they are still alive then you implement yourself right there.Brett acted on a split second,and in a split second his life was flashed before him and he was thrown in jail and all freedom and all his rights were then stripped from him...The true fact is we live in a civilization that we are truely GUILTY until you prove your INNOCENCE.Brett our prayers and thoughts are with you my friend and the time you spend doen time for anothers crime maybe in the end it will outline a few laws that will protect men put in the position that you were put in hopefully what you do is not done in vain my man because noone deserves to pay for no one elses mistakes,and the state needs to be held accountable for the tyrants they bring in off the streets with no values and putting them in a position where they can basically take a mans life with lies a deceit and in not handing over the exculpatory evidence is a major crime that needs to bw adressed and the prosecutor needs to be held accountable for his deceit and negligence in this case,and Bretts lawyer needs to go back and re practice law sence when do you let the prosecuters evidence "speak for itself"?Thats ridiculas and he needs to be dibared.Im 100% behind the Hartman family and any American who beleives in truth and justice would also be behind them so anybody reading this write the authorities and let them know Brett deserves a fair trial and he needs aquitted of all chages if thats the truthful findings,nothing special just truth and honesty what we as Americans pride ourselves in and expecially in our justice system.Hang Tough my friend my heart and prayers are with you....Your Friend Gene
