Dear Friends, Kevin Scudder is a paraplegic with one leg. He is on death row at ManCI. To further complicate matters, he is on chemotherapy for Hodgkin's disease. He is suffering from the fact that the staff at Mansfield is not trained or experienced in managing his type of handicap. They seem to have become resentful of his special needs and are treating him very badly. He should be at CMC which is the Correction Medical Facility. The staff there is experienced and equipped to handle cases like his. He would also require much less onerous and expensive trips to OSU for chemotherapy and follow up. Please help him by writing:

If we can get enough letters to the Committee we should be able to stir them to action and get him transferred. Thanks for your help.

It was then deleted from this section because of the wording used. This was at my discretion. As I've said before, we have no way to verify information given or posted about other inmates. We only gather what we can since the web site ohiodeathpenaltyinfo.typepad.com/ohio_death_penalty_inform/ is no longer being updated. Even though this is more of an anti death penalty board, and everyone is entitled to their opinion, I chose this action so that family members or supporters of this man would not stumble upon the post without knowing the possible content. As always, if you see a need for more boards to be developed, want family boards, or password protected inmate sections, etc, please just let me know.

Kevin Scudder – the next volunteer to be executed in Ohio? by Michael Manley April 1, 2000 Kevin Scudder, age 37, was convicted in 1990 of murdering Tina Baisden, age 14. The charge of aggravated murder included attempted rape and kidnapping specifications. On December 14, 1990, Scudder was sentenced to death. The basic facts of the case are these: On February 6, 1989, Baisden left her home in the company of Scudder and two others. On February 7, early in the morning, Scudder came home wounded and was taken to Mt. Carmel Hospital. Later, Baisden’s body was found in a field near Scioto Downs. She had been stabbed 46 times. Even though Scudder has maintained his innocence of the crime, he told his attorney in December 1998 that he was “tired of living on death row” and that he wanted to waive his remedies and be “put down” by the state; a month later, he explained to his attorney that “the voices in his head told him not to appeal or he would die that night” (Affidavit of Attorney Keith A. Yeazel, filed Jan. 20, 1999). The attorney had serious doubts about Scudder’s competency, and he expressed them to the Ohio Supreme Court. However, Scudder changed his mind and sought further review of his case. He continued with this determination for the last year. Then, on January 7, 2000 Kevin Scudder refused to sign a habeas petition and informed his attorney that he wanted to be executed. The Ohio Supreme Court set an execution date – April 25, 2000. Scudder has a legal history and a long history of physical and mental health problems that raises serious questions about his competency. He was born with a cleft palate and amblyopia. He has been diagnosed with paranoid schizophrenia, organic brain damage, sociopathy and drug dependence. He was charged with breaking a man’s jaw in 1980, but found not guilty due to insanity. He was committed to the Lima State Hospital for the Criminally Insane, and sent to the Central Ohio Psychiatric Hospital and the Mansfield Correctional Institution. In the Franklin County Correction Center, he is reported to have attempted to hang himself, and there are further indications of suicidal tendencies in the record. After his leg was broken in a 1982 auto accident, he insisted it was cancerous and demanded to have it amputated. The leg was finally amputated when a deep venous thrombosis was detected. He is now catheterized and in a wheelchair. The record clearly shows that Scudder has suffered all his life from emotional disturbance and serious mental illness and that he has, in fact, been found incompetent once. His present lawyers have filed 24 separate claims for relief, beginning with the claim that the defendant “was incompetent to stand trial or go forward with any subsequent legal proceedings. No court evaluated his competency in compliance with federal constitutional standards” (Habeas Petition, p.1). The next friend petition itself raises the question of competency that must be resolved before Scudder may be allowed to waive his remedies. Whatever the courts should decide about Scudder’s competency during past proceedings, they ultimately might need to address his competency to be executed since the execution of the insane has been found unconstitutional as a violation of the Eighth Amendment (Ford v. Wainwright, 1986). Now that the case has been brought before District Court, Judge Marbley is proceeding with a competency hearing. If Scudder is allowed to waive his remedies and be executed, major questions about the constitutionality of his case will never be answered. In addition to the question of competency to stand trial or to go forward with subsequent legal proceedings, there are significant questions about evidentiary issues, including the evidence obtained during an illegal search and seizure but still admitted at trial; the witness, never called, who might have placed the victim near the crime scene with other people at a time Scudder could not have been there; and seriously flawed DNA results, never adequately critiqued. The problem with all cases involving volunteers is that the habeas process is not completed, so the public has no assurance about constitutionality. On February 19 last year, Wilford Berry became the first death row inmate executed in Ohio in 36 years. Berry had also “volunteered” to be executed and had a lifetime of serious mental illness. It should be a matter of grave concern to the people of the state of Ohio that homicide is committed in our names with our tax dollars. If the courts fail with Scudder, the Ohioans to Stop Executions will appeal to the governor to grant him clemency. Since time is short, if no stay is issued, we believe Ohioans opposed to the death penalty should contact the governor now, urging clemency. First, I would like to point out this prisoner is NOT a paraplegic! He is NOT paralyzed. He ELECTED to have one of his own legs amputated. Big difference! Second, some details that were not mentioned and I feel is pertinent information. Kevin Scudder also raped an 18 year old girl and was under going sentencing when he was an in the auto accident that broke his leg. (Coincidence? I don't think so) Then, because HE then chose to have his leg amputated, they postponed the sentencing. It was at this time that he murdered a 14 year old girl. He then stabbed himself in the back and went to the hospital with a made up story about being car jacked by 2 Black men. He claimed that they shot him in the back as he escaped (remember he only has one leg)and left a healthy 14 year old Tina behind. However his DNA was all over Tina, after he stabbed her 47 times! It was also proven that he was stabbed, not shot and it was proven to be self inflicted wounds per the medical specialist that examined him and testified in court. Do I feel sorry for him? NOT AT ALL! He should have thought about how he would live out his life in Prison BEFORE he RAPED an 18 year old girl and then MURDERED a 14 year old girl a few months later!!! He took a sweet innocent girl before her time and possibly ruined another young girls life. He deserves everything he gets.

I'm related to Tina through my moms side of the family. Is extremely disgraceful and hurtful to see the story being Twisted to make kevin a victim after what is did to Tina. Also he's not a paraplegic. That's a lie. He's the worst kind of Predator. He is a child predator.He raped an 18 year old girl and then a few months later.He killed Tina You can try to victimize him all you want but I'm sure you would have felt different if it was your daughter. He can Proclaim his innocence all he wants But the cold hard facts Is that Tina fought for her life...Literally there was skin underneath her fingernails and in her mouth that skin belongings to kevin. You people are free to believe what you want But I encourage you to do your own research the case files are public and you can read them online for yourself. He secluded Tina from her friends and then killed her. This has haunted my family for years. What about tina?!? She's the victim.

But Obviously you're okay with the murder and rape of a 14 year old girl! I'm really glad your family has never experienced anything like this! No, I am not okay with any crime; nor am I okay with how the death penalty is applied, the flaws of the appellate system etc. Hopefully you can see that we are in different places on the subject, and that should be okay... Eyewitness accounts, It also shows how many times he's tried to manipulate the facts to make his self seem innocent. Anyone who was an adult w kids back then remembers this case well. Keeping him alive is a waste for taxpayers money. The Bible clearly states in eye for an eye. At least he gets a Humane death unlike the young lady he killed and stabbed 46 times. Actually now that I think about it The karma in all this is that despite your protests. he's still slowly wasting away on his own...suffering in bad health because god works in mysterious but great ways. This message board seems to be pulling on the wrong Heartstrings. I just can't believe how well you've turned him into the victim in this. I don't really know who's more manipulative him or you. Nobody can escape God's Wrath and maybe he's actually supposed to sit in there and rot away instead of a quick death. I genuinely hope the victim's family takes great joy in his suffering.

Am I for the death penalty, in some cases yes, in others no.
This man was accused,tried and evidence proved BEYOND a reasonable doubt, that he in cold blood murdered a 14 year old girl during the commission of an attempted rape,and this wasn't his 1st time raping someone.
He knew what he wanted to do to her and had his plan in mind. He purposely made sure that he was alone with her dropping others off and then going the opposite direction of her home. Took her to a secluded area with all intents of raping her. And when she fought back he purposely stabbed her to death. This isnt a case of it was an accident I didnt mean to, or because of my missing leg or whatever other ailment he wants to use as his excuse. He stabbed her 48 times out of anger because she fought back and was trying to prevent her rape at his hand.
He has lied and tried to manipulate his was off death row for years. Hell the man lied trying to frame fictional "black" men for her killing. Where is the outrage for that? Where is the outrage for him taking the life of a 14 year old girl during her attempted rape? Where is the outrage for the other 18yr old rape victim? Where is the humanity/sympathy for them? Or does it only exist when people are sentenced to death for crimes they beyond a reasonable doubt committed?
This man deserves zero sympathy NONE. He is in this position because of his own actions. He has noone to blame but himself. He is the definition of evil. And in my personal opinion her family should be able to stick the needle in him 48 times. He gets an easy way out, fall asleep peacefully. Tina, she didn't get that. She died in fear while this man brutally murdered her while trying to rape her. His other rape victim has to live with her rape every day for the rest of her life. So he should be glad that he just gets to close his eyes and not wake up versus what he put Tina and his other victim through.
That's the thing I don't get from people who are 10000% against the death penalty. People sympathize with the perpetrator, awww poor him/her there should be no death penalty. Do you think that crosses the convicted persons mind when they are brutally murdering the victim. Where is the outrage for the victim? Where is the sympathy for them?
Look I am not 10000% pro death penalty. I get there are some cases when the convicted wasn't the one to commit the ceime, there are plenty of case files out there to prove that happens. But what about cases like this? It was proven 10000000% proven that he did this, hands down noone else was involved, he brutally murdered TINA MARIE BAISDEN in cold blood during the commission of an attempted rape. So why spare his life when he had zero I mean absolutely zero sympathy or remorse for what he has done? The only thing he does is the poor me routine to get sympathy from people. All while having zero sympathy for the brutal murder of Tina and the rape of his other victim.
This case is open shut. He did this. He brutally murdered Tina, evidence proved it factually and with accuracy. He deserves no sympathy, he deserves no extended time or life without parole. He sentenced a girl to death because she didn't want to be raped. So why shouldn't he be sentenced to death for his crime?
