Judge sides with inmate on death row A Sixth Circuit Court of Appeals judge dissented against the majority Monday when they sided with the appellate court regarding Ronald Post, who is on death row for the December 1983 murder of Helen Vantz. Post, 40, appealed to the federal court that his counsel led him astray when he pleaded no contest for the robbery and shooting death of Vantz in an Elyria hotel. He argued his then-counsel, Lynett McGough and Michael Duff, led him to believe he would not be sentenced to death by a three-judge panel if he pleaded no contest. Post also contended a jailhouse confession should not have been used because the inmate he confessed to was recruited by prosecutors to get the confession without a defense attorney present, which is against Ohio law. Circuit Judge Guy Cole believes the issue of the jailhouse confession should be remanded to the appeals court. Cole also states Post’s defense counsel acted unconstitutionally when they encouraged him to enter a no contest plea solely “on the hope” he would not be sentenced to death. He also pointed out no written guarantee was made ensuring Post would not face the death penalty. “I believe that the constitution requires attorneys to make strategic judgments based on something more concrete than unsubstantiated hope, especially when their client’s life hangs in the balance,” Cole wrote. Cole also wrote the defense attorneys acted wrongly because they relied too heavily on a pre-sentence investigation prior to the death sentence, rather than having their own investigation. The defense counsel also allowed a victim-impact statement, made by Vantz’s son, to be included in the report, when it wasn’t required and negatively affected the outcome of the case. “I believe that had this evidence been presented, had Post’s family witnesses who did testify been adequately prepared, and had Post’s counsel not called the murder victim’s son as the final witness to testify ... one of the three judges would have voted not to impose the death penalty.” More;morningjournal.com/articles/2010/09/15/news/mj3321216.txt

Execution date set for man who killed Elyria clerk The Ohio Supreme Court has set an execution date of Jan. 16, 2013, for convicted killer Ronald Ray Post in the 1983 slaying of hotel clerk Helen Vantz that occurred while Post was robbing the Slumber Inn in Elyria. Post, 52, has exhausted his state and federal appeals but will still have a chance to ask the Ohio Parole Board to recommend clemency to Gov. John Kasich. Lorain County Prosecutor Dennis Will said he will oppose clemency. “Nobody has presented any evidence to my office that shows clemency is warranted,” Will said Tuesday. The Weight of the Guilt The mistakes that put Ronald Post on Death Row are no joke Sympathy was a tough sell for Ronald Post once his story went viral. Last week, lawyers pushed paperwork through the court system warning that things could get ugly next January, when Post is scheduled to be executed – his punishment for a 1983 robbery-homicide. Weighing in at 480 pounds, the 53-year old Elyria native is simply too obese for a standard lethal injection to work, they argued, at least in the painless and timely fashion required by law. The news wires piped the story to outlets across the world, and by midweek Post's photo was splashed across the website of the UK's Telegraph. Meanwhile, on prime time MSNBC, Nancy Grace was wrestling the Botox-lacquered planes of her face into an approximation of outrage while fuming over the absurdity of the argument. Her general take was that a cold-blooded killer was trying to leverage weight that he gained in jail into one last desperate Hail Mary. But the too-fat-to-die argument is only one corner of a much more baroque, convoluted legal circus outlined in court documents. Well before their client became a global punchline, Post's legal team was trying to jam up Death Row's clockwork with a meatier argument that has nothing to do with pant sizes. Their main contention is that for almost 30 years, the entire foundation of the case against Ronald Post has been based on bad information. Hello, I am the wife of Ron Post. Despite any solid evidence against him, he is scheduled to be executed in January. The recent press coverage seemed to find his weight issues more important than the issues surrounding his unjust conviction.

Hi ronniesgirl, Do you know of any website or have a case synopsis that may highlight the reasons his conviction was unjust so that we may help you circulate that information. (I think the Cleveland Scene article has some of the information, but perhaps you have something on the order of a list?) Also, I don't see a petition for Ron on the IJPC site. If you start one, know of one, etc. please let us know so that we may help circulate that also.
(As a family member of a death row inmate I can empathize with frustration related to media.)

The government has already filed motions claiming the federal court does not have jurisdiction. Post’s public defender’s have claimed factual inaccuracies were made by prosecutors and he should have the right to correct the information, which would pave the way to reopen the case.
